We, Speciality Restaurants Limited is inter alia engaged in the business of operating restaurants, food and beverage brands, and curated culinary experiences (hereinafter referred to as “Speciality Restaurants”, “Company”, “We”, “Us”, “Our”). We are committed to protect the privacy and security of personal data, belonging to and/or provided by any person who accesses or uses (hereinafter referred to as “You”, “Your” or “User”) any of Our websites, and all internet and mobile based products and services offered by Speciality Restaurants Limited (https://www.speciality.co.in/) (hereinafter referred to as “Platform”).

This privacy policy (“Privacy Policy”) describes the terms by which Speciality Restaurants offers to collect, use, and process a user's personal information when You access Our website (“Website”) (website URL address: >https://www.speciality.co.in/) or otherwise use Our services. The Company, being in charge of managing the Platform, respects Your privacy, and seeks to comply with all the Applicable Laws and other statutory requirements in India in respect of data collection, processing and transfer.
This Policy does not apply to information that You provide to, or that is collected by (i) any third-party through Our Website and (ii) any third-party websites that You access or use in connection with the Services offered through Our Platform. The Company shall not be liable for and has no control over the practices and content of any such third parties. You consent that the collection, storage, processing, disclosure and transfer of any information shall not cause any wrongful loss to You, if it is done in accordance with the provisions of this Policy.
We shall not be liable for any loss that may happen to You or any other person providing Us with wrong information. Please read the Policy carefully before using Our Platform or accessing any material, information or availing any Services through the Platform.

A. YOUR APPROVAL

  1. 1. You can accept the Agreement only if:
    1. You are a natural person of the legal age and sound mind to consent in Your jurisdiction and are fully able and competent to understand, acknowledge and agree to the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Policy; or
    2. You are a juristic person, lawfully existing that has all the authorizations, permits and allowances to enter into this Agreement and form a binding contract; or
    3. You are not legally barred under Applicable Laws from using the Platform.
  2. You understand that We want You to use the Platform if You understand, approve of or accept the Agreement in its entirety. If You do not agree to this Agreement, please do not use or access the Platform. Your use of the Platform is at Your own risk, including the risk that You might be exposed to the content that is objectionable, or otherwise inappropriate. Hence, You are requested to read this Privacy Policy carefully and understand the Agreement before You accept it and agree to be bound by them.
  3. You represent that You are a responsible adult (18 years or above) and You shall be solely responsible for all content that You access through the Platform. While individuals under the age of 18 years may access and use the Services of the Platform, they shall do so only with the involvement and guidance of their parents and/or legal guardians, under such parent /legal guardian's Account. You agree to provide Your details including but not limited to complete name, age, email address, residential address, and contact number.
  4. As long as You comply with this Privacy Policy, We grant You a personal, non-exclusive, non-transferable, limited, revocable right to enter, use, and avail the Services offered by Speciality Restaurants.

B. DEFINITIONS AND INTERPRETATIONS

  1. Any capitalized terms, not defined elsewhere in this Agreement, shall mean as follows:
    1. Applicable Laws: Applicable Law means all laws, statutes, common law, regulations, ordinances, codes, rules, guidelines, orders, permits, tariffs and approvals, of any governmental, judicial, quasi-judicial, statutory or regulatory authorities, particularly those relating to the internet technology, data privacy and logistic services that apply to Company including Digital Personal Data Protection Act, 2023 of India.
    2. Services: Provision of restaurant dining services, food and beverage offerings, reservations, takeaway and delivery services, curated culinary experiences, gift vouchers, and related customer engagement services at the physical premises and through digital platforms.
  2. Any reference to the singular includes a reference to the plural and vice versa, and any reference to one gender includes a reference to other gender(s), unless explicitly provided for.
  3. Headings and captions are used for convenience only and not for interpretation of the Agreement.

C. INFORMATION WE COLLECT:

Our Platform may collect the following information for, inter alia, better facilitation of Services. All aforesaid types of information will be collectively referred to as “Information.”

  1. 1. Personal Information: Personal Information shall mean and include all information that is listed out below:
    1. Name of the user
    2. Contact details (mobile number, email address) of the user
    3. Billing and payment-related information (mode of payment, transaction reference numbers; no storage of card details)
    4. Reservation and order details of the user
    5. Delivery address (for takeaway/delivery orders) of the user
    6. Feedback, complaints, and service preferences of the user
    7. Name and contact details of proprietors/authorised representatives
    8. Contractual and transaction-related information (if it relates to personal information regarding a person and not of the business itself).
    9. Contractual and commercial interactions, including vendor, supplier, and service provider onboarding, contract execution, and payment processing.
    We shall ask You to provide only such Personal Information which is for lawful purpose and necessary to be collected by Us to provide Services. When You use Our Services, You create a user profile which shall require You to share details such as Your name, mobile number, email address, contact data, etc. You may also enhance Your profile by linking Your Facebook, Google accounts or any other third party account on any of the Platform. By doing this, You are authorizing such third party to share information from Your accounts with such third party(ies), and You are authorizing Us to collect, store, and use what We receive from such third party in accordance with this Privacy Policy. Social media registration features may collect Your IP address, the page You are visiting on Our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on Our website. You can disassociate Your registration on Our Platform from third-party accounts any time. Kindly note that We shall not be responsible for any information collected by the third party from You.

Location and Log Information: When You interact on Our Platform, We may automatically collect such information that shall include (i) IP addresses, (ii) Your geolocation information, (ii) time zone (iv) access dates and times, (v) information about Your activity on Our Platform which shall include the sites from where You have accessed Our Platform(s) (vii) type of browser, and (ix) mouse clicks, browser actions.
  3. Usage and Preference Information: We collect information about how You interact with Our Services and settings chosen. In some cases, We do this through the use of cookies, web beacons, tags and scripts, and other similar technologies including local storage objects such as HTML5 and other similar technologies that create and maintain unique identifiers.     Certain aspects of our Services are enabled through third-party service providers and platforms that support Our business operations (collectively, “Third Parties”). In the ordinary course, We may disclose personal data to such Third Parties strictly on a need-to-know basis and for lawful purposes connected with delivery of Our Services, internal operations and compliance requirements.

    Third Parties may include but are not limited to: point-of-sale (POS) / billing system providers, Online reservation, ordering and delivery platform partners, payment gateway and banking partners, marketing and promotional service providers, customer feedback / grievance platforms, and CCTV installation, storage and maintenance vendors.

    This description of Third Parties is intended to provide a transparent overview of common categories of Third Parties engaged by Us. It is not exhaustive and, depending on operational requirements and lawful purposes, We may engage additional Third Parties from time to time.

    These Third Parties may place or recognize cookies, web beacons or other technology to track certain non-personal information about Our website users. For example, in the course of serving certain advertisements, an advertiser may place or recognize a unique cookie on Your browser in order to collect certain information about Your use of the Platforms. For another example, an advertiser or ad server may also be able to collect Your device's unique identifier in the course of serving an ad. In many cases, this information could be used to show You ads on other websites based on Your interests.

    Any content You choose to make public on our Platform such as comments, reviews, ratings, images, or other submissions may be viewed and used by others and by Us for promotional or commercial purposes. We are not responsible for information You voluntarily disclose through such public activities, which may also appear on third-party websites or connected social media accounts and will be deemed shared by You. We may also collect personal information when You participate in contests, sweepstakes, or special offers; if You do not wish such information to be shared, please do not participate.

D. CONSENT:

Collection and Processing of Your Information is subject to Your free, specific, informed, unconditional and unambiguous consent. We agree that the Company will not collect or process Your Information unless You specifically consent to this Policy. If You do not agree with Our practices regarding Your Information, please do not use Our Platform.

You may inquire as to the nature of Information stored or processed by Us. You will have the right to review Your Information and make corrections or updates and request erasure of Information. You also have the right to withdraw Your consent, if necessary, to the collection, use, retention, and disclosure of Your Information.

To the extent that the legal basis for Our processing of Your Information is consented, You have the right to withdraw the consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal. E. HOW WE USE YOUR INFORMATION:

We collect, use, process, store, disclose or transfer Your Information in compliance with the Applicable Laws of India, in such circumstances, where We need to:

  1. perform the Services that You have contracted with Us for, including but not limited to availing of Our Services, or access the content on the Platform(s) and in connection with other ancillary services on the Platform, including facilitating table reservations, walk-in dining, takeaway and delivery orders, gift vouchers, and related customer support and engagement;
  2. maintain and operate internal business systems and records, including storage, maintenance and retrieval of records in physical and/or digital formats, and implementing role-based access and internal access controls;
  3. undertake operational and business communications, including sending service communications and operational updates, and conducting brand communication and campaigns through authorised channels, including bulk WhatsApp messages or emails where undertaken for legitimate business purposes;
  4. engage third-party service providers as sub-processors to support Our operations (including POS providers, reservation/ordering/delivery platforms, payment partners, IT/cloud vendors, customer feedback systems and professional advisors), to the extent necessary for the purposes described in this Policy;
  5. manage relationships with vendors, suppliers, service providers and contractual counterparties, including onboarding, contract administration and payment processing;
  6. ensure security of Our premises, personnel and operations, including through physical and digital security controls and, where applicable, CCTV-related security measures supported by third-party vendors;
  7. provide an enhanced and personalised user experience;
  8. analysis to improve customer relationships;
  9. make suggestions and recommendations to You about Our Services that may be of interest to You by using Your email address and mobile number (by SMS or WhatsApp);
  10. comply with contractual, legal or regulatory obligation;
  11. manage customer communications, including responding to queries, feedback, complaints and service requests received through Our Platform, email or at Our restaurant premises; enhance other information, We have about You to help Us better understand You and determine Your interests and preferences;
  12. development in products offered, which allows Us to improve and enhance the safety and security of Our Services, develop new features and products;
  13. improve Website analytics, user experience, and optimize Our services;
  14. check any account activity in order to prevent fraudulent transactions and ensure the security;
  15. guarantee overall performance and administrative functions run smoothly; and
  16. disclose purposes at the time You provide Your information or as otherwise set forth in this Privacy Policy.

F. HOW WE SHARE YOUR INFORMATION:

G. DATA SECURITY:

We have high regards for Your privacy, and We take all reasonable and appropriate technical, legal, and organizational security measures to ensure the Platform's uptime and protect Your Information from any unauthorized action. In the event of a service disruption or security breach, Speciality Restaurants will use reasonable efforts to restore service and mitigate any adverse effects. We employ industry-standard security practices and procedures, including implementing appropriate security control measures and using secure servers in order to protect Your Information in Our possession from loss, misuse and unauthorised access, disclosure, alteration and destruction. Notwithstanding these measures, please be advised that no data transmission over the internet can be guaranteed to be entirely secure, and We cannot assure the absolute security of Your data breaches caused by factors beyond reasonable control. In the unfortunate event of data breach, We shall immediately inform You as per the provisions of Applicable Law.
By using the Platform, You acknowledge and agree that You are aware of the potential risks associated with using Our Platform and Our liability for any disruptions or security breaches is limited as set forth in this Policy.

H. DISCLOSURE:

We do not sell, trade, or otherwise transfer Your Information to outside the Company without Your consent except with such entities and in such manner as detailed below:

  1. Third-Party Entities: We engage certain third-party service providers and operational partners to support Our business operations and enable the efficient delivery of Our services. These may include point-of-sale and billing system providers, online reservation, ordering and food delivery platforms, payment gateway and banking partners, IT infrastructure, cloud hosting and cybersecurity vendors, marketing and communication service providers, customer feedback and grievance management platforms, CCTV vendors. Such third parties may process personal data on Our behalf solely for specified and legitimate purposes connected with Our operations, and We share only such personal data as is necessary for them to perform the services requested by Us. These third parties are expected to process personal data in accordance with Our instructions and Applicable Laws. We encourage You to review the privacy policies of third-party websites.
  2. Regulatory Authorities: We may disclose Your Information to law enforcement authorities, regulators, governmental or public bodies and other relevant third parties to comply with any legal or regulatory requirements. We may also disclose information about You, if We determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose Information about You, if We determine that disclosure is reasonably necessary to enforce this Policy or protection of Your operations.
  3. Affiliates: We may choose to sell, transfer, or merge parts of Our business or Our assets, alternatively, We may seek to acquire other businesses or merge with them. M. CHILDREN'S PRIVACY:

Our Services are not intended for children under 18 years of age, and Speciality Restaurants does not knowingly collect or use any Information from children under the age of 18 years of age. No one under 18 years of age may provide any information to Us or on Our Platform(s). We do not knowingly collect Information from children and take reasonable measures prevent such collection of Information for children.
However, in the ordinary course of providing restaurant dining, reservation, takeaway and delivery services, personal data of minors may be incidentally provided (for example, where reservation or order details include information relating to children). Such personal data, where incidentally collected, is processed only for the limited purpose for which it is provided and not for tracking, behavioural monitoring, profiling or targeted advertising.

N. INDEMNITY:

You represent and warrant that the information provided by You and regulated by this Privacy Policy is true, correct, consistent and accurate and that You agree and shall indemnify and save harmless the Company from time to time, promptly upon demand against any and all losses, claims and/or actions relating to or arising out of any inaccuracy in the information provided by You.

O. AMENDMENT TO PRIVACY POLICY:

We may update this Privacy Policy from time to time to reflect changes in Our practices or for other operational, legal, or regulatory reasons. We will periodically notify You of any changes through Our Website, as per Applicable Law. The earlier version of this Policy can be accessed on Our Platform.
You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

P. GRIEVANCE REDRESSAL:

  1. If You want to request access, correction, or deletion of Your Information, You may write to Us at with the subject “Data related Grievance”. Upon receipt of Your complaint, the Grievance Officer will acknowledge the complaint within 24 (twenty-four) hours and will make best efforts to resolve the matter within 15 (fifteen) business days of receiving the complaint or as per timelines mentioned in the Applicable Laws of India.

Q. GOVERNING LAW AND JURISDICTION:

  1. The Agreement shall be governed by and construed in accordance with the laws of India. Subject to Clause Q(2) and Q(3) any Dispute arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India as applicable.
  2. In the event of any dispute or difference between You and Us (“Dispute”), then such Dispute shall first be resolved amicably through good faith negotiations by You and Us. In the event that a resolution of the Dispute is not achieved within 30 (thirty) days from the date such Dispute arises, as notified in writing by any party to the other party, then any of the parties to the Dispute, shall have the right to refer such Dispute to arbitration by issuing a written notice.
  3. Any Dispute shall be referred to an arbitral tribunal consisting of 1 (one) arbitrator to be appointed by Us. If the parties fail to appoint an arbitrator within 30 (thirty) days of notification of the Dispute by any one party to the other parties, then the parties shall approach the courts of competent jurisdiction for appointment of the arbitrator as per the provisions of the Arbitration and Conciliation Act, 1996 (“Act”). Any award by the arbitral tribunal shall be binding on all the parties. A reference to the arbitration under this paragraph shall be deemed to be submission within the meaning of the Act and the rules framed thereunder for the time being in force, as modified from time to time. The parties further agree that the seat and venue of arbitration shall be Mumbai, Maharashtra, India and the language to be used in the arbitration shall be English.
  4. The existence and content of the mediation and arbitration proceedings, including documents and briefs submitted by the parties, any correspondence from the mediator, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting the mediation or arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.

R. MISCELLANEOUS

  1. This Policy constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
  2. This Policy describe the relationship between You and Us and does not create any partnership or agency between You and Us and You shall have no authority to bind Speciality Restaurants in any manner, whatsoever. This does not create any legal rights for other people or organizations, even if others benefit from that relationship under this Policy.
  3. All communications and notices made or given pursuant to this Policy must be in the English language. If We provide a translation of the English language version of this Policy, the English language version of the Policy will prevail if there is any conflict.
  4. If any provision or part of a provision of this Policy is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, such term, condition or provision will to that extent be severed from the remaining Policy which will continue to be valid to the fullest extent permitted by law. Rights and obligations under the Policy which by their nature should survive will remain in full effect after termination or expiration of the Policy. If any provision of the Policy is held invalid by any law or regulation of any government, or by any court or arbitrator, the parties agree that such provision will be replaced with a new provision that accomplishes the original business purpose, and the other provisions of the Policy will remain in full force and effect.
  5. Any express waiver or failure to enforce any provision of this Policy will not constitute a present or future waiver of such provision nor a continuing waiver or any expectation of non-enforcement or a limit on Our right to enforce such provision at a later time.
  6. Under Applicable Laws, You have certain rights that cannot be limited by a contract like this Policy. This Policy is in no way intended to restrict those rights.
  7. This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
